            The Tangipahoa Parish School Board met in regular session on Tuesday, September 23, 2003, at 6:30 p.m., in the School Board Meeting Room, School Board Office, 59656 Puleston Road, Amite, Louisiana, with President Robert Caves, Presiding.

 

MEMBERS PRESENT:           Robert Caves,  Al Link,  Carl Bardwell, Sandra Bailey-Simmons, Leonard Genco, Robert Potts,  Donnie Williams, Maxine Dixon and  Jimmy A. Richardson, I

It was moved by Mr. Richardson, seconded by Mr. Bardwell, to approve the Board Minutes of September 2, 2003 and September 16, 2003 as distributed. Hearing no objection, the motion was unanimously adopted.

 

Mrs. Pat Hutchinson, School Food Service Director, made a presentation to Mrs. Bennie Jackson, Hammond Jr. High School Cafeteria Manager. Mrs. Jackson was selected as Manager of the Year for 2002-2003.

 

Mrs. Hutchinson also made a presentation to Ms. Lillian McGee, Food Service Worker at Amite High School. Ms. McGee received an award for four (4) years of perfect attendance 1999-2003.

 

It was moved by Mr. Bardwell, seconded by Ms. Dixon, to approve the Superintendent’s Goals and Objectives as submitted along with the two (2) additional Goals and Objectives suggested by the Board. Hearing no objection, the motion was unanimously adopted.

 

It was moved by Mrs. Dixon, seconded by Mr. Richardson, to approve the Personnel Committee Report of September 17, 2003 and Addendum #1, with the exception of Item #9 (Administrative – Transfer/Reclassification) on the original report. Hearing no objection, the motion was unanimously adopted.

 

It was moved by Mrs. Dixon, seconded by Mr. Link, to approve Item #9 (Administrative – Transfer/Reclassification). An electronic vote yielded the following results: eight (8) Yeas: Mr. Caves, Mr. Link, Mr. Potts, Ms. Dixon, Mr. Bardwell, Mrs. Bailey-Simmons, Mr. Genco, and Mr. Richardson, Nays:  one (1); Mr. Williams. The motion was adopted.

The Board recognized Mr. Darrell Fairburn, newly appointed Supervisor of Personnel. Mr. Fairburn thanked the Board for their vote of confidence and stated that he looked forward to serving as Supervisor of  Personnel.

 

            It was moved by  Mr. Williams, seconded by Mr. Bardwell, to approve the Finance Committee Report of September 2, 2003. Hearing no objection, the motion was unanimously adopted. Following is the report as approved.

 

1.      Approved the Accounts  Payable  Check  Register dated 6/30/03  and 7/31/03 – 8/26/03.

2.      Approved the low bids for Bid #03-41, SFS Large Equipment.

3.      Approved the low bids for Bid #03-47, SFS Commodity Processing.

 

It was moved by Mr. Link, seconded by Mr. Potts, to approve the 16th Section Ad Hoc Committee Report of September 11, 2003. Hearing no objection, the motion was unanimously adopted. Following is the report as approved.

 

1.      Authorized Mr. Reed and his staff to go out for bids to harvest (clear cut) the 16th Section Property adjacent to Vinyard Elementary School, and to structure the cutting as to whatever is in the best interest of the Tangipahoa Parish School System. 

 

2.      Approved the assignment of the Right-of-Way and Grant Predial Servitude with Mr. Bruce Meyer relative to 16th Section Property north of Lewiston Baptist Church.

TANGIPAHOA PARISH SCHOOL BOARD, a political subdivision organized under the laws of the State of Louisiana, represented herein by its duly authorized representative, having a mailing address of 59656 Puleston Road, Amite, Louisiana 70422, and Tax Identification Number of 72-6001372 ("School Board");

 

AND

 

BRUCE R. MEYER AND MAGGIE ALLEN MEYER,  husband and wife, living and residing, persons of full age of majority and domiciled in Tangipahoa Parish, having a mailing address of ___________________________, and whose Social Security Numbers are __________________ and ____________________,

Respectively (“Meyer”);

 

who, after being duly sworn did depose and say:

 

That for and in consideration of the mutual covenants herein expressed, the School Board conveys unto Meyer, his heirs, successors and assigns, a servitude over existing roads on property owned by the School Board in the Southwest Quarter of the Southwest Quarter of Section 16, Tl S, R8E, Tangipahoa Parish, Louisiana.

 

That for and in consideration of the mutual covenants herein expressed, Meyer assigns unto the School Board, its successors and assigns, all of his non exclusive right of use over and across the following described properties, to-wit:

 

From the POB which is the common comer of Sections 16, 17, 20 and 21, of the Tl S, R8E, proceed W along the Section line between Section 20 and 21 a distance of 200 feet, thence North 30 feet, thence East 200 feet to the Section line between Sections 16 and 17, thence South 30 feet to the point of beginning. Said right of way being in Section 17, TIS, R8E, Tangipahoa Parish; and said right of way acquired by Meyer from Sidney Ricks, Sr. by right of way agreement recorded at COB 495. Page 840 of the records of Tangipahoa Parish.

 

AND

 

From the common comer of Sections 16, 17, 20 and 21 of the TIS, R8E, proceed West along the line between Section 17 and 20, distance of 170 feet to the POB, thence South 30 feet, thence West parallel to the Section line to the right of way of the North Lewiston Road, thence North to the Section line, thence East to the point of beginning. Said right of way being 30 feet in width and extending along the north side of the North Half of the Northeast Quarter of the Northeast Quarter of Section 20, TIS, R8E, Tangipahoa Parish, Louisiana; said right of way acquired by Meyer from Kenon Kyzar by right of way agreement recorded at COB 495. Page 839 of the records of Tangipahoa Parish, Louisiana.

 

Each party agrees not to obstruct or interfere with the use of the right of way and servitude conveyed herein.

 

The right of way and servitude granted herein shall run with the land and be enforceable in favor of the respective parties, their heirs, successors and assigns.

It was moved by Mr. Link, seconded by Mr. Potts, to waive the rules to consider an item regarding access to 16th Section property in the Lewiston Church area. Hearing no objection, the motion was unanimously adopted.

 

         It was moved by Mr. Link, seconded by Mr. Potts, to authorize the Board’s attorney to enter into an agreement with the landowner to provide the Tangipahoa Parish School System with access to the southeast section of the 16th Section property in the Lewiston Church area. Hearing no objection, the motion was unanimously adopted.

 

         It was moved by Mr. Genco, seconded by Mr. Link, to waive the rules to consider RFPs for Antivirus Solutions. Hearing no objection, the motion was unanimously adopted.

 

         It was moved by Mr. Genco, seconded by Mrs. Bailey-Simmons, to approve the Structured Data Systems Proposal for Computer Associates Product in the amount of $31,747.00 including installation and desirable options. Hearing no objection, the motion was unanimously adopted.

 

            It was moved by Mr. Link, seconded by Mrs. Bailey-Simmons, to approve the Hammond Board Delegation Report of  September 17, 2003. Hearing no objection, the motion was unanimously adopted. Following is the report as approved.

 

1.      Approved the request of Hammond Westside Upper for three (3) computers, software and one (1) printer for the administrative office, in the amount of $4,511.28 from Pay-As-You-Go Funds.

2.      Approved the request of Hammond Westside Primary for technology upgrades in the amount of $49,697.24 from Pay-As-You-Go Funds.

3.      Approved the request of Hammond High School for the purchase of a new typewriter and the purchase of a new digital camcorder, not to exceed $1,200.00 from Pay-As-You-Go Funds.

4.      Approved the request of Woodland Park Early Learning Center for new computers and software for twelve (12) kindergarten classes, in the amount of $38,640.00 from Pay-As-You-Go Funds.

5.      Deferred the item regarding remodeling Hammond High School counselor’s office.

6.      Authorized the staff to obtain estimates for modifications and installation of equipment to upgrade Hammond High’s Home Economic Department into a commercial kitchen, in conjunction with the Louisiana Restaurants Association.

7.      Assistant Superintendent Mark Kolwe gave the committee an update on the Wal-Mart property.

 

It was moved by Mr. Potts, seconded by Mr. Genco, to approve the request of Spring Creek Elementary School to upgrade its telephone resources in the amount of $2,556.90. Hearing no objection, the motion was unanimously adopted.

 

It was moved by Mr. Potts, seconded by Mr. Genco, to approve the request of Sumner High School for computer equipment in the amount of $3,692.04. Hearing no objection, the motion was unanimously adopted.

 

It was moved by Mrs. Bailey-Simmons, seconded by Mr. Genco, to adopt an appropriate resolution to place a signal light at the  Intersection of Highway 40 and Highway 443 in Loranger, Louisiana. Hearing no objection, the motion was unanimously adopted.

 

RESOLUTION

 

 

WHEREAS,  The Tangipahoa Parish School Board does actively seek to ensure the safety of its students;

 

            WHEREAS,  A problem with traffic congestion does exist at the Intersection of Highway 40 and Highway 443 in Loranger, Louisiana;

 

            WHEREAS, School buses arrive and depart from three school campuses daily. Faculty and staff members’ automobiles, and family vehicles bringing and picking up students, create additional traffic;

 

THEREFORE BE IT RESOLVED, In the interest of safety and the orderly flow of traffic to and from the schools, as well as other normal traffic, the Tangipahoa Parish School Board does request that the Louisiana Department of Transportation and Development render its assistance by placing a signal light at the aforementioned location;

 

BE IT FURTHER RESOLVED, That this resolution be forwarded to Mr. Robert P. Roth, Jr., PE, District Administrator – LA DOTD and Mr. Alan Dale, District Traffic Operations Engineer – LA DOTD, requesting their assistance in this matter.

            Mr. Richard Tanner spoke in public  input regarding the upcoming election and legislative matters.

 

            It was moved by Mr. Genco, seconded by Mr. Richardson, to enter Executive Session to discuss the cases of James Troy Jones v. Patrick Balisteri, et. al and Cynthia Givens v. TPSB. Hearing no objection, the motion was unanimously adopted.

 

            The Board entered Executive Session.

 

            The Board returned to Open Session.

 

            No action was taken in the case of James Troy Jones v. Patrick Balisteri, et. al. It was moved by Mr. Richardson, seconded by Mr. Genco, accept the attorney’s  recommendation in the case of Cynthia Givens v. TPSB. Hearing no objection, the motion was unanimously adopted.

 

            Mrs. Bailey-Simmons introduced her mother, Mrs. Dorothy Hughes during personal privilege. She informed the Board that her mother made eighty-seven today.

           

It was moved by Mr. Link, seconded by Mrs. Bailey-Simmons, to adjourn.  Hearing no objection, the motion was unanimously adopted.
